Introduction: Welcome to Tactical Traders LLC, a service provided by Justin Werlein LLC (“we” or the “Company”), located at 8175 E Evans Rd, Scottsdale, AZ 85260 By accessing our website at tacticaltraders.net and using our Services (as defined below), you agree to these Terms of Service. Service Description: Tactical Traders LLC offers high-ticket coaching services (the “Service”) for trading. The Service includes assistance in developing, understanding, and implementing trading strategies and systems but does not include specific trading recommendations or advice. The Service is non-subscription based and requires an upfront payment of $4200. Payment and Refunds: The Service costs $4,800 upfront and $97 a month after 6 months. Due to the nature of our Services being time-based, the upfront fee is non-refundable. However, refunds may be granted under certain circumstances at the sole discretion of the Company. Limited Guarantee: If a client completes the entire program, does every piece of homework, attends every class, attends every coaching call, submits all requested accountability documents, and documents every trade they took while attempting to pass a challenge, they may be entitled to additional sessions with the Company until they become successful. Proof of all the above must be provided to [email protected]. Limitation of Liability: Trading involves significant risk and may not be suitable for everyone. We do not guarantee any specific outcomes or profits or that losses will not occur. Any trading decisions you make are solely your own responsibility and risk. Disclaimer: The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind, express or implied. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its affiliates and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking and makes no representation of any kind that the Service will meet your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards, or be error-free or that any errors or defects can or will be corrected. Without limiting the foregoing, neither the Company nor any of the Company's providers makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components. Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law. Indemnification: You agree to indemnify, defend, and hold harmless the Company, its officers, members, directors, employees, subsidiaries, affiliates, and representatives, from any and all losses, including, but not limited to costs and attorneys’ fees arising out of or related to your use of the Service or the website at tacticaltraders.net ; your violation of any term or condition of these Terms of Service; your violation of the rights of third parties, including but not limited to intellectual property rights or other personal or proprietary rights; and violation of any applicable law, statute, ordinance, regulation, or treaty, whether local, state, provincial, national, or international. Governing Law: The laws of the State of Delaware, excluding its conflicts of law provisions, shall govern these Terms of Service and your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws. Disputes Resolution: If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company. United States Legal Compliance: If you are a resident in or access the Services from a location outside the United States, you are responsible for compliance with all applicable laws. You agree that you will not use the Services or any content accessed through the website at tactical traders.net in any country or in any manner prohibited by any applicable laws, regulations, or requirements. You represent and warrant that (i) you are not located or resident in any country that is subject to United States’ sanctions or government embargo, or that has been designated by the United States government as a "State Sponsor of Terrorism" or country providing support for acts of international terrorism, and (ii) you are not listed or included on any United States government list of prohibited or restricted persons.
